I don't think it's reasonable to say the written law is completely irrelevant. It provides a standard to (try to) hold people accountable to. There is definitely a societal problem with the way the law is implemented (what you call "law as practiced").

The discrepancy in who ends up in prison is a gendered issue, but I think of it separately from prison rape. Prison rape is a gendered issue in that, for instance, it's more broadly socially acceptable to joke about men being raped in prison than women. I see that as a problem with society's reaction. Prison rape, the phenomenon itself, is utterly wrong no matter what the gender of the victim is. There is nothing that can make it more okay to rape a man than a woman (or vice versa). I don't think it's helpful for anyone to pretend that one gender of victims doesn't exist, and I think you should not have implied that prison rape is limited to men.

Statutory rape is complicated and mishandled by itself; the case you link to just adds layers of injustice.

Finally, though this will be obvious on an anonymous internet forum, you don't know me. You've guessed a gender for me, an ideological history, an agenda. You've even drafted me for a war. Your guesses are as good as can be expected from having read one sentence of mine, which is to say, fairly bad.
