A Black Male, favored prey of US Law Enforcement, Charged With DUI Despite Blowing .000 During Breathalyzer Test

Haaaaahahah, talk about a misleading title! Okay, yes, it's entirely possible for someone to be charged with a DUI before doing a Breathalyzer test. Funny how that whole concept of time works.

Here's what actually happened:

Man was pulled over while driving for a surprise test.
Despite passing the makeshift sobriety tests (y'know, the "walk in a straight line" or "spell the alphabet backwards while shifting feet" kind), he was arrested with a DUI anyway because he had bloodshot eyes. Possibly other reasons (not unlikely considering he's just out of a gym), I don't trust CBS to not omit relevant information in the name of a good story.
Officer accused of mishandling him.
At the station, they do proper tests and find him innocent. DUI charge dropped.
His car his still impounded despite not having a DUI anymore.

In other words, the Cleveland system they have means that a person can be arrested on a DUI based on the officer's best judgement (which is bad, and most countries don't have that from what I've seen), the system isn't set up for when DUI charges are dropped, the man accused the officer of misconduct, attorney says it's racism without proof (no guesses why), and you should not trust CBS to give you clear and unbiased news!

DUI (driving under the influence) has several sub clauses in all states. One of which can be "driving under the influence" of drugs. Which of course, you would not have any alcohol in your system if you were driving under the influence of drugs.
