The quotation marks in the headline are because so far it's alleged in that despite the messages and videos, she hasn't been officially convicted. The fact that it says she has been accused of raping him rather than just "accused of having a sexual tryst" is an improvement

I am totally with you on the idea that newspapers tend to discuss sexual crimes by men and women differently, and in ways that benefit women and harm men. So I am not challenging that idea at all.

However, I am not sure your thoughts on this particular case hit the mark. Here is what I think is going on: The quotation marks are there because they are quoting someone else. The newspaper itself is not calling it a rape, they are stating that someone else called it a rape. Per my earlier comment, I suspect one reason that the newspaper took this approach is that, under UK law, what happened does not fall under the definition of rape. If the newspaper itself called the event a "rape," it would be inaccurate and - worst case - the paper could face defamation liability.

More generally, a newspaper generally will only use the term "rape" if the acts alleged fit the legal definition of rape. That definition varies significantly by jurisdiction. In many cases, horrible sexual crimes, often including acts committed by women, simply do not fit the definition. In many jurisdictions, the word "rape" does not appear in the relevant statutes at all! When the facts alleged do not meet the definition of rape, it is reasonable for newspapers not to use that term.

Again, this is just about the use of the term "rape," not about your larger point, which I absolutely agree with.

According to UK law, the headline is incorrect. This is because "rape" is whatever the governing law says "rape" is.

Under the Sexual Offences Act 2003, their are four distinct offenses, set out in four different statutory sections, related to sexual activity without consent: rape (section 1), assault by penetration (section 2), sexual assault (section 3); and causing a person to engage in sexual activity (section 4). See here.

To be guilty of rape (section 1), a person must "intentionally penetrate the vagina, anus or mouth of another person with his penis." That is, rapist is the one penetrating, not the penetrated party, and that penetration must be with a penis. Only men can rape. Added: Unless a woman somehow helps a man penetrate someone. See here.

Section 2 covers penetration with something other than a penis (so women can do it), but also requires the offender to be the one doing the penetrating, not the party that is penetrated. See here.

The woman in this case may have violated section 3 (sexual assault) and/or section 4 (causing a person to engage in sexual activity). But, again, both of these offenses are different than rape, which is covered by section 1.

Added: It looks like their are parallel provisions covering sexual activity with a child, but the boy in this case is above the relevant age and, in any event, they follow the pattern discussed above. See here.

I mean their not calling it what it is. Flashing someone is not rape. I wouldn't call a man flashing someone rape either. Is streaking at a ball game raping everyone in the crowd?
