The girl is above the age of consent and (presumably) consented to the sex. It is not statutory rape, and if she consented, it is not rape of any other kind (at least legally). I have never seen a news report featuring a male perpetrator in the same circumstance that called it rape.

She's a teacher in a school for troubled youths - that's abuse of power and position, it's predatory

Of course her behavior is reprehensible, but that does not mean that the law defines it as rape. If someone isn't being charged with rape, calling them a rapist is defamation.

Age of consent under 18 is conditional not absolute. In the overwhelming majority of western jurisdictions anyone under 18 cannot consent to sex with an authority figure such as a teacher or employer, caretaker, doctor etc. They also cannot consent to sex for money. In this case this is absolutely a statutory rape.

I have never seen a news report featuring a male perpetrator in the same circumstance that called it rape.

Of course, her behavior is reprehensible, and I am not defending her, but according to the law she is not a rapist, and publishing an article that referred to her as one would be defamation. This occurred in Pennsylvania, where the age of consent is 16. Sex with a minor under 18 and over 16 can apparently be charged as something called "corruption of a minor" but it is not statutory rape. Whether or not anywhere else in the world would consider this rape or not is irrelevant, she is not a rapist according to the laws of the jurisdiction she is being prosecuted in.

I mean, this article talks about the double standard and makes valid points, but it seems to be talking about whether crimes are referred to as sexual assault rather than rape.

I can't find any indication of the age of the student, so I can't say whether this article is defaming the accused or not. It also never calls him a rapist, but says he was "accused of rape", which is different.

There is no indication that the girl consented, especially considering she filed the police complaint herself. Additionally, this occurred in India where the age of consent is 18 and the victim was 16, also making this at least statutory rape.

This also happened some time ago with a female gym teacher/female student reported as a "sex romp"
