Edit: they were found on her possession on school property, but nowhere does it say in the gym. Unless you find a source that says it was in the gym, then don't make it up. Wow, she was behaving erratically at track practice (gym class for short) when a number of students notified the school who called the police. They found heroin on her on school grounds. THEN they found pictures that sound like explicit material of the minor student and her on her phone. Then she confessed to the one year spanning sexual assaults. Then she was booked.

furthermore to your point, in many locations sex with a minor is considered non-consensual (because a minor cannot consent legally) hence it is legally statutory rape (although not necessarily aggravated rape in the legal sense) in some people's eyes.

All that said, she did get 90-120 days of JAIL time, not PRISON, but still incarceration. THAT, said, we all know that a man who is taking heroin on campus and taking pictures while having sex with a minor would get way, way more than what this woman got. Which is the whole point of this sub- women are typically given a slap on the wrist compared to the punishments men receive.

well, R Kelly might be a bit of a long shot comparison given his style of threatening young women (it has been said that he would lure them into the hotel first and then they were pressured physically or something along those lines) but you are accurate in stating that teachers are in a position of power to convince the students that it is ok. A teacher being convinced by their student that it is ok is not better to me than a teacher convincing a student- they should carry the same weight of punishment IMO. The teacher has the power and the risk and they should know that in either case. The only enhancement should be if the teacher full on tried to blackmail the student and then that is a different, much worse case of rape and power abuse anyway.

As to the double standard you speak of, it has been noted that women are frequently sentenced very different from men with regards to sex with students. That, as noted in the article, has to do with inherent judicial and social bias against men in sex crimes cases- women/girls are viewed as having been convinced whereas men/boys are viewed as doing the convincing even in the way some laws are written. Women's traditional gender role leads many to think of them as less threatening whereas a man's is viewed as very threatening. Girls are far more likely to report a teacher they are engaging in sexual acts with than a boy because the social system looks out for female victims of sexual assault whereas male victims frequently encounter a more mixed reception, i.e. he may be high-fived for the "conquest" or he may be harassed for "reporting instead of enjoying". In the end, the double standard is not simply a legal phenomenon. It is rooted in a social stereotype that needs to be abolished.

If some underage dudes had evidence of Ariana Grande or Pink taking them to a hotel and then pressuring them into sex the resounding public sentiment would be "why is this a problem for you?". I mean, legally they would prosecute it but the public would laugh it off and the judge would probably give a light sentence while saying that the underage boys were willing participants, ignoring that the woman was preying on boys.

It might seem effectively the same, but there are differences.

Detention Centers are where detainees (not prisoners) are temporarily confined by the government while awaiting trial, deportation hearings or some other non-criminal, civil process such as mental health evaluation and/or trial for civil commitment to a mental hospital.

Jails are facilities confining persons who are in the custody of the government, such as accused persons awaiting trial, convicted persons serving a short sentence, probation violators, those found in contempt of court, and sometimes also holding civil detainees for court ordered child support violations and civilians held for mental health evaluation and/or trial for civil commitment to a mental hospital).

Well that seems a different argument. One that seems to happen regularly on other subs. Here in this case, I personally would not be that happy if my kids are being taught by the heroin junkie. What if there is a medical emergency or something. Is the lady going to have her shit together to act quick enough? What if a kid gets hurt or injured? Can we count on her and the school to take responsibility? Or would we see a cover up and blame game... What if one of her students finds her stash? AND this is all before one takes into account that this person is doing hero-fucking-in and their judgement is no doubt impaired. WHAT if she is high as hell and decides to start banging students? Heroin is much more dangerous. It also depends on the age of the boy. If he’s like 17 he’s old enough to know what’s up. That doesn’t mean she shouldn’t lose her job, because she absolutely should, but I wouldn’t suggest jail time for that. I’d feel the same way if it were a man. The real problem here is how men are treated much more harshly. I don’t think it’s a case of women not being treated harsh enough, it’s men being treated too harshly. There’s a big gap in how they’re treated and that’s not right.

I think she should be treated more harshly. At my work, I don't fraternize with women despite it not being forbidden. I just don't shit where I eat. She is potentially damaging the kid, committing felonies, exposing him to IV drug use (even if he's not using) and the host of diseases that brings along with it. You think the heroin addict possesing and using at school, that fucks teenage boys, is simultaneously making safe decisions like not sharing needless or fucking her dealer bare back when she needs a fix? That's the whole point. Sexual contact brings a while host of potential issues. It doesn't matter that each case is unique, or that hers may be worse in some regard. The point is a person in position of trust and power, in a role that the government forces upon the child (illegal to be truant) should be held criminally liable for breaching that trust.

Her example makes it easy to point out avenues in which the child could've been harmed. That doesn't mean it's only a problem if those particular avenues exist. And of course "the act of sex" itself isn't harmful. At the end of the day that's just thrusting motions with the hips. We're taking about the psychological and physical effects.

Why should we clog prisons and jails with people who have sex with other people who are 6-7 months shy of being 18? Many don’t support jail for drug possession, and in this case she had heroine. It is also illegal to coerce an employee into sex, or for police officers to use intimidation to get sexual favors. Weird how those abuses of power don't seem to hit your radar, but the one diddling teenagers is a-ok.

Why should we clog prisons and jails with people who have sex with other people who are 6-7 months shy of being 18?

If you want to make the age of majority 17.5, then fine, that's your argument. Something tells me some idiot will then be arguing "What's the difference between 17 and 17.5!?!"

Many don’t support jail for drug possession, and in this case she had heroine. Which is a bigger threat to society, the fact that she had sex with a student, or heroine?

I don't care if they're 18. If they're a student in a K-12 environment they should be off limits. If they're 18 and it's a college professor, yeah, then it shouldn't be criminal but the professor should lose their job for a breach of professional conduct.

Lmao. Acting like you are enlightened. Prison is way better than jail. County jail has awful food, 1 shared TV per pod, limited rec time, etc...

Prison has personal tablets to watch TV, send emails, play games, etc. There are also video game systems and multiple TVs to hook them up to. There are microwaves, good commissary, and meals like in a high school or hospital cafeteria. There is also a lot to do as far as recreation, outdoor stuff, schooling opportunities, etc...

You people really think prison is worse than jail? Lol! Maybe in a supermax...

Prison has more amenities to pass time because a person is there for a LONG time and usually they are upstate or in some far flung rural area.

Far away from home and any and ALL family and visitors.

Far away? Depends. It certainly doesn't mean inaccessible. Prison inmates can easily correspond with email, collect calls, and scheduled visitation. Some facilities are even adopting tablets with cameras so that inmates can interact with their families and friends through Skype-like video calls.

You can't even have face to face visits in jail unless you've been there at least 30 days. You can also make money in prison, whereas jail offers a very expensive Work Release program which only applies to low risk charges.

DOC sentences can be a short duration -- even just a couple months. That is the contrast that I was arguing since you mentioned "90 days in jail." If I had to serve 90 days with those two options, then it'd be in a low or medium security prison. Keep to yourself and don't flex, and you won't have any problems.

I've seen my fair share of both, so this is a somewhat educated inference. Of course, your mileage will vary.

Anyways, I apologize for being rude in my first post. It was uncalled for.

My main point is that criminals serving time at DOC have it way too easy. It's almost comfortable living.

underage in Georgia I believe means under 16 but IANAL. It could be that the student was 17 for all we know.

Regardless, having sex with a student is full of issues which is why it is prosecuted almost entirely the same in most jurisdictions for men. As for women, it is usually very different and a woman's looks as well as the willingness/advances of the male student are usually much more of a factor. That's because men are viewed as instigators whereas women are viewed as being instigated despite the basic premise that the teacher has the power and should know better anyway regardless of who is pressuring whom.
