Probably not. Hire a forensic accountant if this goes to trial.
If this is part of a settlement, though, entitlement is all this is. They may feel entitled to the former value of investments, but the current value is what most likely would be considered.
But that's in court.
Background: Had to fork over half of investment account, based on the account value the day of actual divorce after a full trial. In California. If California doesn't hold you responsible for interest rates and market sentiment, I doubt other states do.
