This is not about the assumption of children spending 50/50 time with each parent. Its about parental responsibility, about both parents remaining parents in law. When a parent loses parental responsibility, they are losing the right to have any say in the upbringing of their children, and right to consent or object to a child having surgery or moving residence overseas. In effect, on the premise that the assumption that both parents continue to be parents after divorse or separation leads invariably to domestic violence against women, this assumption has been revoked. Evidence? Anecdotal evidence provided by feminist dominated service providers and legal services.

Issues of domestic violence have always been considered by the courts when deciding issues of contact between parents and children, residence of the children. The myth that the presumption of shared parental responsibility forced women into continuing exposure to violent men, is just a myth. While in some cases women have endured domestic violence due to court ordered contact with the father of their children, in the vast majority of cases, there no violence, only the bilateral conflict associated with relationship breakdown. Now all fathers will be treated as potential abusers, and any accusation of domestic violence, no matter how trivial or false, will be sufficient to end fathers' parental responsibility with their children. This ploy will allow mothers to have complete control over the upbringing of their children, without inconvenient fathering getting in their way.

Australian children, already suffering a crisis of fatherlessness, are now more likely to have no meaningful relationship with their fathers. Fathers are once again eing punished for their maleness, and pushed out of families, regardless of any proven issues of domestic violence.

I live in Australia and I’m a young man. I’ve always wanted to have kids and get married. But that was a idealistic fantasy.

Now I just want a LTR without kids.

Fuck! Police are "misidentifying" women as perpetrators of domestic violence.

30% of perps are women when police id it, 9% when courts do.

And for some reason they assume that the ones that are on the scene are the ones getting it wrong!

And they point out a bunch of problems caused when cops get it wrong as if it's only women affected, as if those same problems aren't problems for men.

And then there's not even a recognition that men can be victims, nevermind misidentified as perpetrators.

Fuck I could rant about this, basically every paragraph passed me off.

I see not issue with history of family violence being taken into account, if it was not for a fact that women abuse it and make false claims and are believe solely based on their gender.

Notice they put in that violence is alleged in 80% of cases? Yet it clearly doesn’t occur to them that figures this high indicate that allegations are being used as a legal tactic. How do they propose to deal with this?

I think we all know the answer to this: they don’t. And the sob story they ran. Why was the girl spending most of her time with her father?

I'm wondering how this will interact with the coercive control laws in the states that have it/are getting it.

I saw a corroners report that claimed "a history of domestic violence" based on the guy turning up to his seccond property, where his wife was living, every now and then to mow the lawn and do matinence. Apparently this was "stalking" because one time he left before mowing the lawn. (Did look like he later caught her cheating and killed her, so not an innocent guy, but ) that seemed like a stretch to 'history of domestic violence'.

I'd hate to see that standard applied to custody.

Presumed simply means it’s the default position. I do not doubt that violence or sexual abuse would already have been taken into account. It’s “presumed” rather than “must”.
