Wife and I decided we think its best if we got a divorce after a short marriage (2.5 years, but been together since 2015), we haven not filed anything with the courts yet, but are in discussions on how to go about our assets and debts. we also don't have children.

- Currently living together in our primary residence in california, and split the mortgage payments with our w2 income
- both have 401k , probably similar amounts (200k)
- I get RSU/ESPP options from my company that vest over 4 years from grant (~1.5 mill total, 400k communial property)
- Throughout majority of our relationship she rarely paid for anything, so all her income mostly went to her own investments (stock, funds, etc). im guessing she may have 150k+ investments?
- Mom and I had an investment property since 2016, and after I got married to my wife. she requested that I add her to my half of the title, since she had also made some investments ( 80k) to add an ADU to the property. she is also not on the mortgage.
- We bought another property few years ago for investment purposes, she covered the down payment for 50k. both names on title and mortgage. After going through city permits, we are finally breaking ground on construction.

Prior to this, we verbally agreed we'd use my RSU to fund the project. Now that we are splitting, she is strongly suggesting we do not touch each other's assets and just split the investment income generated from the 2 properties, yet she expects me to still front majority of the cost of the project (300k). And when said i think we should split the cost now, she threatened me saying she would go after my assets if we had to split the construction. As i understand she can only go after my stocks options that were vested after the marriage correct?

I am also trying to convince her we take 1 property each. meaning the one with my mom and I, Id keep + the income. The one under construction would be hers + future income. They would be making simliar income. But she is really against this idea because she says she put alot of effort into the other property as well.

I feel like our situation is already complicated hence why i wanted to go lawyer route, but could also make it more complex. Wondering if Its worth to go through lawyers or should we just settle between us and figure out the property split later and I still unfront the construction cost as planned.
