I’ve been going through a divorce for the last 2 years. Separated from my ex for over 3 years. We had an agreement when she moved out of state with our kids. After about a year, she decided to not allow me to see my kids anymore and break the agreement we had notarized. Filed the paperwork for divorce + asking to see my kids. Filed in the state she moved to. Which our notarized agreement isn’t “recognized” in. Temp order came within a month. We had mediation set up and cancelled several times over the course of a year. Then when my attorney pushed for mediation, opposing counsel said they want to hire a forensic accountant, AFTER 1.5years of us trying to set up a date for mediation. They are stating that I have off shore accounts and hiding money (this isn’t true and FA will confirm) This is clearly a tactic to extend this divorce. Judge allowed it of course AND IS MAKING ME PAY FOR IT.
Ex isn’t paying her Morgage and it’s affecting my credit score. She can’t afford the house and refuses to get a job. Ex has turned my kid to never want to take my calls or see me. I have spend over $100k on this divorce so far.
Luckily the last judge we got in front of gave us a Trial date in September and told my ex to get a job (I doubt that will happen it’s been 3years+ of her refusing, she is college educated and had a good job for a long time.) But we are court ordered to go to mediation after the forensic accountant is finished.
I just have a feeling opposing counsel will come up with more delay tactics? Like going through every single transaction because in this state they don’t go by separation date. So all this time we have been separated, my ex is trying to take half of everything I have earned.
What delay tactics did you have to go through? Any advice? This divorce is bleeding me dry. I don’t understand why we can’t just have a judge decide right now who gets what and be done with it.
Everyday I wake up with anxiety wishing this would just end, I just want to be done. I can’t buy anything with my money because I’m “married” and she will take half of it, if not all.
Anyone in the process of divorce, don’t wait to file and don’t expect it to be cordial. ALWAYS GET A COURT ORDERED CHILD CUSTODY AGREEMENT BEFORE YOU AGREE TO ANYTHING.
