Jesus christ, is one thing to not charge women and is just another to dismiss the charges entirely because they're MINORS.

I side with the autistic woman, but of course because autism advocacy is still very looked upon in society of course nobody will give a rat's asses. This is where prosecuting under "hate crime" is justified to me and what the law was meant for: protecting the truly vulnerable in our society ie people with disabilities. Deincentivization of opportunists preying upon them is what I thought was the true goal, but apparently not.

This was an aggravated assault as well as a hate crime.

September 5th, 2019 SAN ANTONIO — A woman says she and her daughter, who has autism, were attacked at a Rohde Park on the northwest side.

The alleged culprits, a group of teenage girls.

That mother is now frustrated with police, who she says don't plan to do anything. "My daughter never had a chance, she didn't even see it coming," Dawn Holzer said.

Holzer was at Rohde Park with her daughter and the 3-year old they babysit, when she says three teenage girls started mouthing off at them for no apparent reason. "Telling me, 'Oh I'm going to bring my mamma over here and my older sister to take care of you," Holzer recounted. "And I'm like okay for what reason?" That's when she says she called police about the disturbance, harassment, and threats. Before officers arrived, she says her daughter was attacked.

"Pulled her head down the second girl came in and started punching my daughter in her face, knocked her glasses off and then the third one jumped on her back and they fell to the ground," Holzer said. She says she tried to break things up and was pushed to the ground herself. "I jumped up immediately that was my quick instinct because I was afraid they were going to start pounding on me next because I was down on the ground," Holzer said.

While two of the girls, ages 13 and 15, were beating her 21-year old daughter, the other teen stepped back. "And she started videoing it on her phone and saying get her, get her," Holzer said.

Her daughter suffered a black eye and a broken arm. "I was afraid, the way they were hitting her, I was afraid of her going into a seizure because my daughter is epileptic," Holzer said. Her daughter also has Autism.

The San Antonio Police detective investigating the case messaged her saying he's been unsuccessful at obtaining any cooperation from the other parties and was preparing the case for filing with the district attorney. Two weeks later she says he called to say no charges will be filed.

"I asked him why and he says well you have to understand these are minors, well I don't care if they're minors they act like an adult, they were cursing and acting like they were adults and coming at a 21-year-old that has disabilities the way they were," Holzer said. In a statement, SAPD Spokeswoman Romana Lopez explained.

"No charges will be filed due to the lack of evidence in determining who the aggressor was since both parties sustained bodily injury."

Holzer says those injuries were scratches. "They need consequences like an adult. It's not right," Holzer said.

Weeks later her daughter still suffers physically and emotionally and she has the medical bills to prove it. She says she and her daughter don't know the girls or why they launched the attack.

Holzer said, "My daughter is not the type to go around and do that I was sitting right there and I know she didn't do anything to them neither did I." She's not giving up on her fight for justice. She believes her daughter's civil rights are either being violated or ignored.

tbf if she is heavily autistic she might have gone into one of those tardrages

and having been around tisms they are out of mind and control so id need soem more context before giving my opinion

if she wasnt charhed its probably due to legit insanity
