Good point. But one party (we know which party) could take the other to court to invalidate the arbitration clause.

Prenups can be dismissed by the judge if they deemed so.

If a prenup is specially harmful to the woman it will be dismissed, they're not worth the paper they're printed on.

The issue is that most people don't get prenups to begin with, because most people getting married don't have any real assets since they are just starting out. By the time they get divorced however, they do, and that's when the problems begin.

Nothing matters in divorce court 1+1=3. It is really about state run terrorism and child abuse. That is the only way to make sense of it.
