If one want a functioning society the latter is inevitable. An advanced society without monogamy will never work, loser men will outnumber the winning men and neverending violence will ensue. So if we're going to have monogamy then severe punishment for women acting on their hypergamy needs to be in place, this behavior not only destroy the family, it rips every incentive for a man to invest in a family in the first place.

Your cheating wife and her lover would mostly likely win since it's two against 1 witnesses. The honest man would most likely be put to death when he took it to the elders. Getting evidence back then would be hard. I would be far easier to make them disappear from the village.

These laws would work a lot better today. Since we have a lot of technology that can be used to provide evidence. Everyone has a camera today, it's not hard to take a picture of your cheating wife.
