Can businesses be forced to accept gender quotas?

In the US, business effectively already has gender quotas, and it's been done in a truly sinister way. It hasn't been legislated, but rather been done through the courts. Any subjective measure that an employer might use in making employment and/or promotion decisions is subject to question through the lens of gender.

An employer should be able to make these decisions based solely upon which employee could reasonably be expected to be a bigger asset to the company. However, should that decision go to the man, the employer can have a reasonable expectation of being sued on gender basis. Now here's the kicker...let's say you manufacture truck tires. You're looking to hire wholesalers. Now you're getting applications from all over, including one from a woman who majored in truck tires in college or some such. If fact, she's the world's leading authority on truck tires. However, your customers, the people who use your tires, are used to dealing with men when they buy their tires. So you hire only men. You get sued. Some judge, with no knowledge of marketing or anything else for that matter, decides that since this woman knows so much about tires your only reason for not hiring her is that you're an evil, sexist bastard and as such need to be punished. The fact that she can't make any money for you is, in the judges eyes, completely immaterial.
