That ruling would only potentially apply in his district. It wasn't the SC.

The judge's decision, favoring a group known as National Coalition for Men and two men of registration age, would have no immediate effect. It did not block the government's current policy. Any appeal by the agency would go to the New Orleans-based 5th US Circuit Court of Appeals before it would reach the Supreme Court.

that Judge is not with the Supreme Court; he's a judge out of Houston. There are higher courts that will certainly have to hear appeals. the article even mentions that the next court of appeals is the 5th Circuit Court in New Orleans. - If they agree and the government continues to appeal then it would be up to the Supreme Court to make a final decision on the constitutionality. Until then the Judges ruling has no impact anywhere outside of the jurisdiction of his court.

It's unlikely that the government would change their behavior before the Supreme Court renders a verdict.
