There's always a level of personal responsibility on both parties when they're drunk and thinking about having sex. That's part of being an adult.

Having said that, you cannot just use a blanket term like "they're drunk" to state that it's now rape to sleep with them, especially when that only applies to women and not men. Adults still have a level of personal responsibility, even when they're drunk.

But if they want to throw that responsibility out the window when you're plastered, then we should all be allowed to get out of any drunk driving charges because we couldn't make a rational decision about driving (since we were soooo drunk).

I think it depends on the situation. If someone has fainted then yes it's obviously rape. But having sex with drunk people in general is not inherently rape, that's absurd.

The only time you should be considered too drunk to consent, is when you are passed the fuck out unconscious. Drunk sex should not be considered rape.

Also not being able to remember what happened does not mean you were passed out either. Decide to go to bed drunk, then decided to come back down not too long after, drink more and act a fool and didn't remember shit about the coming back down part. Thought people were making it up, then someone busted out the video. I didn't appear to be retarded drunk, like sideways falling into walls and shit.

I dont know guys, reading that feels wrong to me. there are alot of nuances to this situation. Are they in a physical relationship already? Did they meet at the party?

I've had drunk sex before and I think that there is still a level of consent but it's hard to gauge exactly how drunk someone is and because its hard to judge people should err on the side of caution unless they are in a committed physical relationship which I believe gives implied consent.
