They already won. No one is looking at outcome. Cosby may of won in court but they already buried that man alive

Cosby may of won in court

For those not keeping track of the trial: Cosby didn't win in court. The retrial (after jurors couldn't decide) will be in April.

Moot fuckin point. It’s just so they can save any lost face in the witch hunt

The whole thing was bullshit. Just look at how all those "accusers" were systematically dismissed from their claims. They continuously changed their stories and their lawyer is the same piece of shit lady that screwed over Michael Jackson. We really need to overhaul the justice system as well as the news/media libel/slander and obligations. None of these accusations should be published in any article because it unjustly attacks the accused every single time. It also constantly destroys the jury pool making any court case already in trouble. We should make it so if they want to publish the story they must retract both the accused's name as well as the accusers OR just not let them report on it until the case is over with and the sentencing has happened. Either that or force them to dedicate the same amount of coverage of the accused when they are found not guilty so they will be less likely to manipulate things in the future.

I think we could push through a legal requirement to conceal the identity of the accused.

[–]LtLabcoat 2 points3 points4 points 8 years ago (3 children) | Copy Link

It'd be nice in theory, but in practice, there's just no way to enforce it. The moment the government says "We're going to punish you for telling people you were raped by [name]", there'll be a national outrage.

Maybe in ye olden days before internet you could, by restricting what newspapers and TV could say and letting locals say whatever they want, but with the internet that's not an option either.

The moment the government says "We're going to punish you for telling people you were raped by [name]", there'll be a national outrage.

But that's not at all how it would get set up.

The obligation would be on the STATE to keep both parties anonymous during criminal trials, and as the state already keeps the victims anonymous in many western jurisdictions, it would be trivial for them to enact similar legislation to keep the accused from being named as part of that trial.

You're right that individuals could out these people (and thus themselves) ahead of the trial, but even in nations with anonymous complainants that still happens. Look at Gomeshi's trial in Canada. Those women waived their right to anonymity specifically so that they could leverage the mob and public sentiment before the trial. If they've chosen to do so, they've chosen to do so, and that ends the state's obligation to provide them anonymity for their criminal case.

I think mostly what people want to see is the tenor of the public argument change. Rather than a pack of lemmings piling on via social media so that a mere accusation ends up getting ramped up into some serious mob behaviour, serious enough that companies start fearing for their brand and proactively firing people, let's change the tenor so that this kind of mob mentality is discouraged rather than encouraged. The message of 'believe the victim', which leads to so much virtue signaling as people rush to be seen as on side with victims as a whole, needs to change to something more neutral. People leaping to public condemnation before the facts are in should be getting called out for that knee-jerk reactionism. Create that stigma for being a lemming, and you'll kill all the virtue signaling dead.

Well, good luck learning the identities of false accusers in the UK. They're kept anonymous even if they're convicted of false accusation. They should be put on a registry. See how they like having to go around every new neighborhood they move to to tell them how toxic they are.

[–]LtLabcoat 0 points1 point2 points 8 years ago (0 children) | Copy Link

I believe people that have been charged and found guilty of false accusation are not anonymous. It's just... rare.

[–][deleted] 0 points1 point2 points 8 years ago (3 children) | Copy Link

How would u do that in practice?

[–]im_not_a_psychic 1 point2 points3 points 8 years ago (2 children) | Copy Link

Like, when someone gets accused, their name cant be released until theyre found guilty. If theyre found innocent, then the accused persons reputation wasnt destroyed.

[–][deleted] 0 points1 point2 points 8 years ago (1 child) | Copy Link

How would u stop all the people involved leaking the info?

[–][deleted] 2 points3 points4 points 8 years ago (0 children) | Copy Link

How do they stop it with the victim, now? Lots of jurisdictions keep the identity of the supposed victim secret to hopefully avoid negative stigma.
