My thoughts too. If she was found guilty and given a short sentence or only community service that would be a pussy pass.

If you read the article, it definitely doesn't sound like she was not guilty. She was found not guilty due to "lack of evidence."

Her attorney told a court at a previous hearing that he had a hair test which proves his client was drugged with GHB.

But the prosecution disagreed, saying that the levels of GHB found in her blood stream were no higher than what would naturally occur in a person's body after analyzing a set of newly obtained blood tests.

Prosecutors also claimed that Radomski had changed her story only when it came apparent she would be charged.

Radomski was initially charged with 21 felony counts, including sexual conduct with a minor, sexual abuse and indecent exposure, but in June last year, a grand jury declined to indict her citing a lack of evidence.

Had she been convicted, Radomski would have faced more than six months in jail and three years of probation.

Even if she was convicted, its six months in jail and 3 years probation. That's a damn light sentence compared to if it were a male in the same situation.

So women should be held to a lower preponderance of evidence in criminal trials?

If there wasn't enough evidence, there wasn't enough. There are innumerable criminal cases which failed due to lack of evidence.

Criminal trials don't work like that; the sentence is given after the verdict.

I'm not familiar with the US state in question, but is it not possible that that's simply the minimum term for that offence?

Hmmm, but wouldn't the sentence be based at least partly upon precedence?

Meaning, "if you commit this crime, you serve THIS sentence because the last 3 trials were decided like THIS." Wouldn't that be a big factor?

Nope. Criminal sentencing is based on standards, and generally isn't affected by past cases - that would require judges to keep track of every case that reaches a guilty verdict in their jurisdiction.

Criminal sentencing should be based upon standards. But often not that isn't the case. See the Stanford Swimmer or the untold amount of female teachers that never see a day in jail for raping of a minor (ie their underage male student). Its well studied and document women get off easier than men.

Firstly, trying to get specific legal details from a DM article is a fruitless endeavour, but either way they state that her acquittal was directed due to a lack of evidence.

If a man was in her position the same thing would have happened, because her intoxication wasn't relevant to her acquittal.
