Thomas Sowell made some interesting related points on how sweeping action can be counter productive for the demographic it's trying to help.

His examples were, paraphrasing perhaps badly:

When hiring for associate professors, hirers were being more careful when hiring women such that they'd want to be sure that this woman would and would be able to complete complete tenure track. If not, this woman stays at associate level, and the department can be accused of sexism. The end result being that you have to promote mediocrity or face wrath.
Affirmative action led to employers being less likely to want to hire black workers as firing a black worker became a minefield.

In both cases, those who were trying to be helped - you're regular, not outstanding candidate - we're now facing different issues, systemised by law. The outstanding women and black candidates still had it good, probably better as they were even more of a safe bet.
