does this not lay the foundation of a law suit for violation of privacy from the victim "ala gawker style"

I would sue her to kingdom come.

Does that break any laws? I get being blacklisted from that employment line but does this legitimately classify as a violation of a law currently on the books. I'd so, what law specifically?

Edit: I understand that she plead guilty to unlawful surveillance but would that actually stand up in a trial?

I knew I would screw up the title. Both men were unclothed. I kept looking at it so I didn't make a mistake and then I did. Plus there are lots of HIPAA

Ah, thanks!

It is against HIPPA patient privacy laws which are Very serious, and every healthcare worker is well aware of.

I would also argue that (HIPPA aside) in a Hospital room, you have a reasonable expectation of privacy. It's not like you're out 'in public view'.

A nurse viewing your genitals in a hospital room would be similar to allowing the nurse into your own home to do the same. Transmitting photos of the inside of your home (letalone your genitals) that aren't public view is certainly illegal. Hence why she got charged with unlawful surveillance.

What's a bit of a bummer is that this isn't necessarily permanent. After 3 years she can reapply. If the fine people of Syracuse are lucky, the board of regents won't ever grant her a license again but something tells me she'll "learn her lesson" by then and she'll be back in the field.

at least she actually got punished, and the police took it seriously. 15-20 yrs ago....this prosecution would never have happened.

I agree, it would be more like..."Was his cock out on the operating table? Well its his own fault for not wearing pants. Who would be stupid enough to have an operation and not be dressed for the occasion?"

if this was a man prosecutors would find a way to put him on the sex offender registry and charge him with sexual assault

For those who did not make it to the end of this short piece she did face charges but took a plea.

the 2nd to last paragraph states:

The felony charge against her was reduced as part of her plea, which also requires Johnson to spend three years on probation.

Asked in a different thread, but does anyone know why she did this? Was it a sexual thing? Famous patients? Something else?
