PBS: Is it time for a national divorce law too?

i get the argument that a woman may "sacrifice" her career to raise kids, while the husband pursues a more time-consuming career that pays more. however when women make that choice they should realize that the marriage may one day end. Sally could have decided not to marry Joe and to pursue a more fruitful career. Hell, she could have pursued a more fruitful career while still married to him, she just chose not to. a better answer would be to keep your marriage vows and not blame poor choices on a husband who happens to make a lot more money than you.

In short, having been married for a quarter of a century, having raised four children primarily on her own, and having sacrificed her own career for decades, Sally’s reward in Kansas is to live the rest of her life at a far lower living standard than Joe. Things are better for Sally and worse for Joe in Massachusetts, but it’s not clear that Sally will receive any of Joe’s assets since the guidelines appear to be mum on that subject.

LOL Sally was always going to live her life at a lower standard of living than Joe.

The federal government doesn't have the power to regulate marriage laws that directly. It can certainly deal with marriage in regards to federal programs like SS. But it can't just create new marriage laws that undue state laws. The constitution doesn't grant that power.

So the first hurdle would be a constitutional amendment otherwise this is just an interesting rhetorical point with no way to act on it.

The only way to get uniformity in state laws now is by either privately promoting a set of uniform standards like they have in the Uniform Commercial Code or by tying highway funds, etc to adopting certain marriage laws.

And frankly I don't trust that uniform laws wouldn't adopt the worst of the anti-male laws.
