Sorry if my English is bad. I am from New Mexico and my daughter (6) and her mother (27) are from NM as well. My daughter has an older sister(8) that is not mine but also identifies me as her dad and I know I have no legal action over her. I was 18 when my youngest was born, the mom was 21, we broke up during the pregnancy and she moved 3 hours away to Las Cruces, NM to live with her mom. I stayed where I was because I wasn't responsible or mature enough to move to a city on my own with no financial support and get a job and an apartment. So a week after the baby was born we got into an fight and hardly kept in touch, never informed me or my family if she was in town, never made an effort to contact me, never let me see my girls, for about four years I saw my daughter a handful of times. The mom would toy with me and refuse to let me see them. So when I turned 21 I saved some money, moved to Las Cruces, NM and I got a job and my own apartment. While it was there I learned the process to establish visitation and custody as a father in NM I made a case and took her ass to court. We were ordered to see a mediator and he was reasonable, my daughter didn't really know who I was and so I didn't get split custody but I was okay with that because now the mom had no say so in the matter and had to let me see my kids. So I got my rights as a father, I could see them anytime in public places, school activities, and sports. We didn't establish a child support officially since that was through the city and separate from the meditator, we agreed to do about $300 a month. For the first 4 weeks they would come over to my apt and have supervised visits, meaning the mom would be there "supervising". After those 4 weeks it was just me and my girls, every other Sunday from 12 to 5 or something like that and they got to know me we had fun and really established a bond this went on for a few months. Well, as luck would have it eventually I lost my job, then I lost my apartment for not paying because I had no job and became so anxious I began having panick attacks so I moved from my friends apartment where I was staying, to Dallas, TX. I picked up a job in Texas, told the mom, told my daughters prior to leaving, promised to FaceTime them all the time. I get here to TX and she says that our mediation agreement is now void since I left the state, I don't have the right to have my kids visit unless she wants to or if she's with them. And now she has it to where I can only talk to them on Sunday 15 min. each, she monitors our calls and doesn't think my communication to be important so if the girls don't want to talk (because they're little and want to play then they don't) I get no call. It's been this way for a year now, my mom has cancer and my dad died last year. So I say let them visit dallas, she says she works too much she can't travel, I say let them fly alone I'll buy the tickets, she says they're too young, I say 5 is too young 6 and 8 is no problem, she says she won't let them fly til they're 11 and 13, I say ELEVEN AND THIRTEEN?? That's 5 years from now, including one year that passed!! My mom may die, my dad is gone, my girls will never meet him, and their mom is a resentful person. My question is, is my court ordered right to have my kids visit me without the moms supervision still active now that I'm in another state? How do I establish a schedule like I had in NM to assure that I get them occasionally? And if I have to start all over, where do I begin
