Don't forget that "Yes means Yes" doesn't mean "Yes means Yes". Affirmative consent policies are "Yes is what you have documented proof of to convince a third party that consent was informed and freely given"

They know exactly what they're doing. The don't intend to actually change people's behavior. They expect that behavior to continue. what they are doing is very intentionally criminalizing what is standard healthy sexual practice.

Think about it. with an affirmative consent law, if you don't stop at every step (and what exactly defines a step is suspiciously absent) and gain verbal affirmation of consent, regardless of whether the other person actually is consenting, then You. Are. A. Rapist. sure you will probably never get charged because the other person would not wish it, but that's the only thing separating any sexually active man from the inside of a cell.

Now, we already have laws defining the state in which one can and cannot give consent, and we've already defined that any expression of revocation of consent is binding and that consent under coercion is not valid. As such the only people "protected" by affirmative consent laws are those who decide halfway through that they do not wish to proceed, but decide not to fucking say anything.

If my friend picks me up in his car and we go to a movie, and i decide during the intermission that I'd like to go home, but I decide not to say or do anything, have I been kidnapped? Hell no. you don't get to criminalize things that happen entirely in the head of the so-called "victim". this is fucking madness.

affirmative concent was concocted to make it easier to expel men accused of rape. feminists were tired of hearing "i thought it was ok because she went along with it and didn't say no," and they know that men almost always initiate, so "yes means yes" is almost foolproof. even if the guy claims he asked at every step, who is going to believe him?

the statute is also written in a way that the accused can't turn it around on his accuser...that is, even if he turns it around to claim that she didn't ask at some point, that won't matter, because she's not the accused.
