So, apparently, if you have sex with someone under false pretenses, you have committed rape.

Doesn't that mean that if a man has sex with a woman who doesn't want it, believing (based on history, body language, whatever) that she consents, but she does nothing to express her lack of consent and goes along with it for whatever reason, she is in fact a rapist?
