Howdy My wife served me divorce papers ~3 weeks ago. She's been physically abusive. I've been emotionally to her (I called her a sl** once and asked how much she weighed when she jumped on me laying down like wrestler move) We both have each other on video. She gave me 1 day to find us counseling a month ago; when I asked her to (as she'd started BetterHelp when she hit me), she snapped and served me in a week. I've had 2 surgeries since June that rquired daily bandaging, etc. She was v helpful. She's said she is undiagnosed bipolar. Her name-mortgage, both of ours- deed. She nannys. zelle into a personal account. decides what she wants to contribute to the joint. I make 2x- It all goes into the joint The day before her lawyer filed, I pulled everything (20k) from the joint. Now she's broke (well getting 16/hr under the table to nanny) and living at her parents across town (small-town illinois). She filed $0 income on 2023 taxes and hasn't paid anything this year. We split phone plan, I took her off my work Healthcare; I took her off 500k life insurance Etc. I suspect infidelity on her end (found kinky sex stuff of hers I've never used on her) I've heard infidelity and domestic abuse of any sort doesn't matter in splitting assets in illinois. She initially wanted the house and 10k. Now she just wants the house. Zillow says only 125k. When her grandma died 2021 her Dad sold it to her for 50k. We split the 15k down payment. My name was added to the deed 3 months ago (after she hit me, I said it was time- as i was and had been the majority joint account contributor that the her name mortgage pulled from- that the utilities her name pulled from- that fixes pulled from).

What should I ask for in my counter-proposal meeting with my lawyer this week? Judge, lawyer, her- female. Lawyer, me- male. MY COUSIN VINNY vibes- I'm only 5.5 years new here; her family knows everyone. Buy her out of her (our now) generational house? Or have her buy me out? Worth 125k; "she" owes 40k to mortgage; both names on deed. We were so in love. Very sad. Blindsiding.
