I pushed for this idea in the beginning of negotiations (put a ceiling on child support, say 2000-3000/month) but eventually ended up agreeing to “table amount” adjusting annually.

For those who don’t know Canadian family law, that’s formula court applies strictly based on non-custodial parent’s before-tax income and number of children involved. Nothing else is taken into account. It’s adjusted every year based on previous years income.

There’s provision in law that allow you to deviate from the table amount for income over 150k. But my lawyer said it’s very hard to not pay table amount unless my income is really much higher from 150k

My income was around 200k at the time of separation. So my lawyer thought a judge will almost certainly ask me to pay the table amount anyway. But now my income is around 500k. I am wondering if I should have negotiated for a ceiling in child support harder.

(The common way to pay less than table amount is shared custody. In my case my ex makes so little I didn’t bother taking that into account)
