This might be more of a rant, but I’ll keep it short. My wife (38f) and I (37m) began the divorce process in April. We have a 3yo son.
For background, I wasn’t a saint and could have been more attentive, but no big ticket regrettable actions. She cheated, stole from our retirement and would be verbally abusive (even while our son was around). But those were only nails in the coffin. We are a bad match even without those things.
Fast forward to recently and despite the normal bickering you’d expect in divorce, all is relatively normal. Then about 15 days ago I get a text from her telling me I should call from my attorney and that she will no longer timeshare as we had been.
Obviously, I call my attorney. He proceeds to tell me she and her attorney filed an emergency motion alleging I was abusive, a drug addict, mentally unstable and a host of other things. It also requests 100% custody.
Lawyer says it’s a shitty tactic and not to worry, but that until the court declines the custody request and we can file an emergency temp time sharing motion, we can’t legally force her to honor a schedule.
So I go through 8 days of not being able to see my kid, to then find out the court ordered her temporary full custody. I am now on day 15 of not seeing him, and it’s like nothing can be done about it from a legal standpoint and the hearing to review her motion isn’t for another 12 days.
Has anyone gone through this? Everything she alleged can easily be proven false. It’s not even “he said she said”. I don’t understand how it takes a month when there is verifiable evidence that she knowingly lied in a legal filing.
