Hey all,

Curious what happens to stock in a divorce.. is it state to state different? I am in California.

I work for a company that is not yet public. I have some vested stock, and not yet vested stock.

I assume when I file, whatever I have vested at that point, would be split in half and stbxw would get half? The rest unvested.. as it vests.. she gets none of after the data of filing, correct?

ALSO.. does she get the stock options itself.. and can choose when to sell it.. or can I KEEP the options, but pay her the value of the stock at that time? Like.. if I have 10,000 shares, each at $1, am I forced to either a) sell 5000 shares to give her the money, or b) does she somehow get ownership of those actual shares and can then hang on to them and sell them? If so.. as she is not part of the company, how does that work? Company allows her to have internal stock? OR c) I can keep the 5000 shares.. so I still have 10,000 but pay her the value of the 5000 shares.. so in this case I would owe her $5K?

Thank you.
