Divorced about 3 years. I am retired and was ordered to pay my ex a percentage of my pension. The verbiage in the decree stated she must file with DFAS, but she never did. I have been paying her directly since we were separated. I have a new lawyer (fighting for custody) who has looked at my divorce decree and told me to stop paying her (now) because not only is it written entirely incorrectly (DFAS will not accept it as it stands) but I have unknowingly been paying her too much as well as paying all her taxes on the payment these last few years. Since it’s well past the 21 days to challenge the decree, what are the chances she could get the decree amended to support her receiving a portion of my retirement straight from DFAS? We separated and divorced due to a great deal of cheating (on her end) but of course you must provide proof to the courts of the actual act of cheating itself which I don’t have. Stacks of texts and records I kept did not count.
