Just curious, I’ve heard it’s really easy to get a temporary DVRO order in California? I’m worried my ex is going to file one since she keeps threatening to do it and she has tried in a previous modification hearing but her lawyer took it off the calendar when the judge said he didn’t see any evidence of DV.

The main reason I ask is because my Ex (daughter’s mom) has these constant meltdowns over frivolous things and when she gets upset she threatens to take our daughter away for good and also threatens to contact her attorney and she does contact him. she has a low cost attorney on speed dial.

I should really file a DVRO on her, we are court ordered to be pleasant to one another and she constantly calls me names, uses expletive language, says bad things about me in front of our daughter and just about finds any reason to have a meltdown. She also allows extra time to be spent with my daughter but then finds some reason to get upset and orders me to bring back our daughter which causes my daughter a lot of emotional issues.

The reason I don’t file a DVRO is because I was told by a previous attorney that it is very difficult for a father to get one and she would likely lose her job and that would cost me more money in child support.

It‘s also very close to the holidays and she has already made it known she can’t stand the fact that I got more time with our daughter than what she had requested in the last modification and that includes 50/50 holiday time on top of the other custody orders.

I read through the form that a person fills out which is the DV-100 I believe? It looks like all you have to do is check mark boxes and write a narrative.

The part I’m worried about is her attorney telling her what to write so the judge grants the Temp DVRO just based on statements. This could potentially have devastating consequences of even just getting a Temp DVRO filed against me as I would have to notify my employer, I wouldnt get to see my daughter until the whole thing is over, I’d have to drive to another state where I own a vacation home and turn in the guns from that residence.

Do judges in California require evidence along with the statements before they grant the Temp DVRO?
