In the UK. Married for 6 years. 2 kids (5 and 2). She left the house and has her own place which is about an hour drive away. I see the kids every weekend and we have a good arrangement for now. Hopefully we can live closer at some point and we can arrange more of a 50/50 arrangement with the kids which she said would be fine.

I have always been the sole provider in our marriage and she was a stay at home mum. She qualified as a primary school teacher and worked a couple of years before our first baby was born. She decided not to return to work.

I am paying her child maintenance which we've agreed between ourselves.

We have discussed divorce but she isn't really thinking about it but I'd like a clean break so I can begin my new life. If we are still legally married, I can't remarry, I can't can't buy a flat without bring financially tied to her.

My concern now is spousal maintenance. She is currently on benefits. She said she gets £800 universal credit a month. Plus child benefit £150. Plus working tax credits. Plus my child maintenance of £300. All her rent is paid for too through benefits. She is has approx £1250 a month. She said when our 2 year old turns 3, he will be in full time nursery so she plans on working minimum hours so it doesn't affect her benefits.

We aren't interested in getting lawyers. If she agreed that she didn't want spousal maintenance from me and she understood she had enough money and that she was happy to have a clean break, would this be simple enough to achieve? As in, would a judge who signs off this divorce, not agree to this? Ultimately she doesn't work and doesn't plan on working full time which means she has 0 income and I have a full salary.

Any advice would be appreciated. I have no assets and just rent my home.
