Man, being cucked at 16, that's tough.

[–]eduardkoopman2 points3 points4 points 7 years ago (0 children) | Copy Link

If true story. It's the parents of this boy their fault, for the most part. because, the 16 year old boy isn't old (and brain develeoped) enough to see far enough into the future and consequences.

The parents of that boy, if they know or find out it's not their biological grandchild. Should had pushed him to drop this, and if necesairy drop (all) support.

The rational part of a teen’s brain isn’t fully developed and won’t be until age 25 or so.

In fact, recent research has found that adult and teen brains work differently. Adults think with the prefrontal cortex, the brain’s rational part. This is the part of the brain that responds to situations with good judgment and an awareness of long-term consequences. Teens process information with the amygdala. This is the emotional part.

Technically he holds all the cards in this scenario, so it’s actually not an entirely bad situation if he thinks red pill. You see, when a simp gets screwed over badly, people know they go on a rampage, that’s why “nice guys” aren’t actually nice.

Jasmine would be very well aware of this at an emotional level (pure fear), more than a logical one:

  • She’s too young to support herself and will remain that way for a good 3-4 years at a minimum
  • He doesn’t have to pay alimony or child support and is can stop supporting her at a whim
  • He can spin plates as much as he wants as he’s under no real obligation, she can’t risk doing that
  • No one else knows the baby isn’t his. That be the talk of the town if it got out who the real father was.
  • The child as it grows up would also believe him to be the real father. The truth would hurt, badly! etc.

So as long as he doesn’t marry her or have a child of his own with her, then she will be fearful of what could happen for at least the first 4-5 years, which would keep her nicely in line no matter what.

He doesn’t have to pay ..... child support

WRONG

"For this reason, you may be responsible for child support, even if you are not the biological father. Sometimes, family lawyers refer to this as “equitable paternity” or “parentage by estoppel.”

You may be considered an equitable (legal) father if:

  • You and the child’s mother encouraged a close, familial relationship, and
  • You held the child out as your own."

Or for people that don't like reading, here an example youtube video:

That only counts where it can be proven that he knows the child isn’t his but claims it to be his anyway.

“When a party has, by his own statement or conduct, intentionally and deliberately led another to believe a particular thing true and to act upon such belief, he is not, in any litigation arising out of such statement or conduct, permitted to contradict it.”

He has to deliberately and intentionally mislead the child and be proven to have done so. Where’s the proof that he knows? No one else knows but him and her and no-one is aware that she told him. So how does anyone besides herself know that he knows? He can just dispute paternity with a DNA test as usual by claiming he never knew the child wasn’t his.

go tell that to this dude: https://www.youtube.com/watch?v=UH9fnRnEcr0

Are you a lawyer, or do you have experience in family court?? Or did you "just" look up what the laws are?

You gotta read up, on your examples. Because the letter of the law, can be different from how it's exicuted.

You seem to have the idea, that family court, will treat a man fairly. That they will give the man a chance. that they will have sense of faireness. That they will treat a man, like a human being. That they will help a man, when he can't afford a lawyer (for ten-thousands of dollars) to do everything properly. And so on.

(I'm not lawyer either. But in the country (not USA) where i life, I'm tax advisor and see th personal financial copnsequances. It's brutal regularly for the dude. One dude even would be homeless, if he hadn't managed to fool a woman to take him in pretending that he liked/loved her.). If one reads the laws here, it all sounds faire-ish; but in reality, it's brutal on dudes. (also due to, here the woman gets (near) free lawyer, and the men has to pay lwayer fees himself. And some women, will just keep filling lawsuits to bankrupt the man with legal costs, and it doesn't cost them much (if any). Stuff like that.

Not a lawyer but I'm from the England where the rules are extremely simple and men are all well aware of them.

It all adds up to: Don't get married, don't be the biological father, don't sign the birth certificate, always refer to yourself explicitly as a stepfather and don't assume any legal guardianship

In general:

1) There's no assumed parentage outside of marriage if you refuse to sign the birth certificate or any paperwork to make you explicitly a legal guardian

2) You have to be an adoptive parent, assigned parent or biological parent for a claim to count.

3) The moment a father denies paternity, a DNA test is required which cannot be denied by the mother - else her claim is denied

4) All payments paid from the moment of denial are subject to a full, immediate refund upon proof showing you're not the father

5) Although the disputing father pays for the DNA test, if he's not the father, he gets a full refund

However, if you are married to the mother and a step-parent in a close familial relationship where you all live together, there are circumstances where child maintenance can be arranged by the court when you split up. But if you're not married or in a civil partnership (the predecessor to gay marriage) then you're fine.

However, even then, family courts over here will not provide legal aid unless mediation has been tried first; no legal representation is required at a mediation session, so the man can simply prove he isn't the father and state that he has never claimed to be the child's father. Although mediators exist for the child's benefit, not the parents, they can't compel a non-parent to support a child that isn't theirs. So no, a woman can't spam the family court with cases...

Addendum: For those who don't know the worst-case scenario if you've done everything right...

1) Child Maintenance Service Claim -> Dispute parentage via DNA evidence, that stops all payments immediately

2) CAFCASS / Mediation Services -> Dispute any claim of parentage saying you're not a parent - done

3) Court Case -> Hire a lawyer to claim "We're not a family of any kind", there's already precedent protecting men

I'm from the England

This topic, is highly country related. I think. It appears USA, is really bad for these things. Worse then UK.
