Earlier this year on March 11, the Citizen's Arrest and Self Defence Act amended the Criminal Code of Canada. I am specifically concerned about Section 34 about Defence. It states the factors that must be concerned by the court when determining whether the act was committed in reasonable circumstances (in regards to the use of force). One factor that must be concerned is "(e) the size, age, gender and physical capabilities of the parties to the incident;". Notice that race is not included by gender is. I feel this may be sex discrimination because both sexes would not be treated equally. Thoughts?
