My divorce has been final for over 19 months. I am remarried. My ex is certifiably insane. At the time of the divorce, I was making over $132K a year, plus a 20% bonus. My life insurance was 8x that amount. Her alimony is $33K a year, plus I pay all of my disabled daughter's out of pocket medical expenses.
I have Crohn's disease, and have had three bowel resections. As recently as three years ago, I spent 10 months in the hospital.
In my divorce decree, I made certain it said the I would indemnify all future alimony with life insurance up to the amount that was available to me through an employer sponsored plan.
So the outstanding alimony is $460K. Ten months ago, due to deteriorating health, I took a lesser job, and with it a lesser package. Now I have $87K in life insurance, which I did name the ex as the beneficiary.
A judge decided to re-evaluate my decree, make me make the ex the beneficiary of my annuities and 401K. And now, they are dragging me back into court to try and get the judge to force me to buy life insurance.
Here is the problem; I have uncontrolled Crohn's disease, for which I am now taking an experimental drug that suppresses my immune system and is carcinogenic. The steroids I take to control the Crohn's have made me diabetic. I also have hypertension, take antidepressants, and other drugs to control the side effects of the drugs I take for the disease.
I couldn't get life insurance unless I lied my ass off. Even then, my hospitalization, which included transfusions, is going to show up in any underwriting. This judge already implied I was lying when I told her I had applied for, and been rejected for life insurance, and that no company would underwrite me at any rating.
So here it is; I am waiting for a judge to order me to do something that I can't do. My psycho ex keeps saying I am insurable and forcing me back into court. If the judge, as expected, makes this ridiculous order, we will have to appeal it to superior court. I am teetering on the brink of bankruptcy right now, and this will probably push me over the brink. This divorce, including the settlement, and future alimony, has cost me everything I worked for my whole life. Now they want my future too.
I am not sure what to do. You can have an ironclad agreement, a cognizant and well reasoned defense, and still, on a whim, some judge can just say, "tough shit buddy. she gets what she wants and you comply or face the music."
One last point, I once held a Life, Accident and Health License as well as a P&C license, and have worked in the insurance industry for over 25 years. The judge shouted me down in a courtroom where I could testify as an expert witness.
