That is a pretty valid question OP is making there.

I'm not sure why if a drunk girl says 'yes' but is too drunk to consent, it's rape, but the guy who says 'yes' and is also drunk is the rapist. Wouldn't "too drunk to consent" work both ways?

A hypothetical:

Let's say that two intersex people go to a bar and meet up with each other. One is dressed as a man and the other is dressed as a woman, or put in place 'performance' or 'presenting' in place for dressed.

They each take turns buying pitchers and consuming them, great laughs and sexy glances are had. Then they stumble to ones apartment, or even better they realize they live in the same apartment building and it is like 'totes' fate or something.

They get to one apt. door but the person who owns it is too drunk to open the door and drops the keys. So the other picks them up and opens the door. The the apt. owner rips the clothes off of the other, the they rip the clothes off of the apt. owner.

For this thought-experiment, let us assume they both have the same tolerance levels and both have BAC's or 1.4, well above the legal limit.

Let us then assume that they have dirty and nasty drunk sex. Let us assume that one uses their penis and the other their vagina for this drunk sex, but remember they both have both.

They are both blacked out and in the morning they don't remember the sex or who penetrated who. Maybe one has a sore penis and the other a sore vagina.

Who is the rapist? Neither could consent. Both willingly drank to the point where they lost control.

Answer: The one with the penis.
