The club I hit up has a hot-dog stand positioned right outside charging 10$ for a footlong. Why? Because drunk people stumble out, whiff the beautiful transfat smells, and fork over way too much for a shitty hotdog. Their intoxication is taken advantage of and they make a decision they would probably not have made sober.

Should people sue the hot dog stand for their money, like "I could not actually consent to this business transaction since I was drunk. I'll need my 10$ and a hefty settlement, thanks"?

Let's say I spent $100 because I got high as fuck and then went to go shopping at a grocery store. Normally I would have kept the trip down to $20. Should I sue Safeway for taking advantage of my mental state? Surely the cashier realized something was up when I smelled like a Snoop Dogg concert.

Why do people think that decisions made by you in an altered state should not be counted as decisions? The only justification is if you were blackout drunk and nonresponsive, or if you were somehow forced to imbibe or drugged. Otherwise, you made the choice to alter your consciousness. The same girl who was "raped" when she and a guy were getting tipsy together could then proceed to drive home, murder someone on the road, and face full charges for manslaughter, DUI, the whole works. How was she fully at fault and 100% to blame in the case of X thing that happened due to her intoxication, and completely off the hook / this poor victim when Y thing happens due to her intoxication?

Drunk sex will never be equal to actual rape and any rape survivor will tell you that. I am surprised actually that more women who have actually been raped aren't coming forward to call out how damaging the "everything is rape" mentality is to actual victims.

Most say exactly that, but then our perceptions are skewed by the fact that:

A: Almost every woman is a "former rape victim", finding out which ones actually have been raped is pretty much impossible.

B: The media isnt going to put anything out there which might upset the feminists

So out of the billions of "victims" only a tiny number are actually victims, and only a tiny fraction of that want to drag it back up again, and only a tiny fraction of that will actually get their voices heard because politics.

One problem with this logic, is this is why minors are considered unable to have consensual relations with either other minors or adults. By having a brain that is not fully formed yet, they have an altered mental state. They cannot be held responsible for their decisions...

That aside, otherwise I like your analogies, and find the argument interesting.

Hilarious insight here. Drunk in one context: you cant make decisions, and no consequences for you! Drunk in second: Your a horrible monster that made the decision to drive drunk, feel the full wrath of the law!

My wife and I who have been together since HS are each others first and only. I remember we had sex for the first time when we were 17. A couple weeks later I turned 18. According to the courts I pretty much raped her for several months i bet, despite every single encounter has always been consensual.

Yea, there is 'rape' and then there is "RAPE". Then, you have rape fantasies where it is rape, but not really and you basically need a safe word in place to get around the whole thing, and even then..you better have a signed document with both your signatures that you were role playing in order to never have that go back on your ass.

I am fully sympathetic for victims of true acts of brutality.

Thank you. It really is insulting to those who have experienced true trauma. They say they are for women, but they are acting like someone getting drunk and having consensual sex is just as traumatic as someone being held down, physically hurt and restrained for 8 hours and repeatedly violently raped while screaming no. It's not "oh no I made a bad decision." its "Is he going to kill me when he's done?"

If we redefined rape a bit more, at least half of the reported rapes would be invalidated. It would free up police investigations to find the really crazy people and get them out of society. I'm pretty sure both men and women would support that. Stop wasting resources on the 19 year old and the 16 year old having sex, or the drunken one night stand, and start using them on the violent offenders.

It's not "oh no I made a bad decision." its "Is he going to kill me when he's done?"

I can practically hear the complaints "oh, now we have to be gang-raped to near-death before something counts as rape?" and "perhaps they are afraid that he'll be killed/beaten up/whatever if they refuse?"
