Unfortunately prenups get thrown out by the judge more often than you think. That being said, avoid marriage altogether

Keep your money in a trust, modern problems require modern solutions
[–]Zulucobra335 points6 points7 points 6 years ago (2 children) | Copy Link
Does this actually work?
[–]Buchwild5 points6 points7 points 6 years ago (1 child) | Copy Link
Yes. They have firms for this kind of stuff, nowadays a prenup means next to nothing and is easily dismissed in court.

This is false too. Trusts just work better not fool proof

In ~80% of states they are outright toothless, either de facto or de jure. And in the remaining states where they aren't, they're little more than a figleaf.

Or you can have a ceremonial wedding. You don’t have to be legally married.

Jeff Bezos is a clear testimony to what happens if you don't take prenups before marriage.

it wouldn't have mattered if he had a prenup because all of his wealth was made years into the marriage, his wife was with him way before he became rich
[–]Glacierdust5 points6 points7 points 6 years ago (0 children) | Copy Link
I'm in law school. Your answer is correct. A prenup is a good idea but it's not enough on its own. A better idea would be to have a prenup and also a trust and/or just keep your assets in crypto because lawyers, accountants and women are somehow afraid to touch that.

True, but she would have gotten a great few either way. I’d be curious how Amazon will continue to do after this. I also never saw if he had to pay alimony or child support. The $40 billion she received was only asset division from my understanding.

Prenups can be tossed easily if the wife says she was “made” to sign it.
[–]PM_ME_YOUR_HANDCUFFS33 points34 points35 points 6 years ago (6 children) | Copy Link
I was told the best way around that is to have her pick any attorney to review it with then you foot the bill. Then no argument can be made that she was compelled to sign it, the attorney was biased, she couldn't afford her own attorney, etc.
Doesn't make it bullet proof but greatly increases its power.
[–]SexualRex32 points33 points34 points 6 years ago (5 children) | Copy Link
Still doesn't do much. My lawyer told me about his buddy, who is also a lawyer, who did basically the same thing and even had some kind of temporary alimony built-in to his own prenup (I think to avoid the potential of having it waived) and the wife's lawyer asked the judge to disregard it because he was unfaithful and broke their vows with absolutely no proof and then he countered with some text messages that vaguely showed it was her who was unfaithful. Guess how far that got him...
Do not get married. Even my own lawyer, who is himself married with young children, advised me to never get married again and said if he had to do it over, he would have just had kids and lived together and risked future child support payments rather than half of everything and future child support payments.
[–]sergio4717 points8 points9 points 6 years ago (4 children) | Copy Link
You mean “half of everything and future alimony”?
[–]SexualRex9 points10 points11 points 6 years ago (3 children) | Copy Link
Sure. Child support from staying single with kids > half of everything, alimony, and child support payments.
Of course if you want kids it's even better is to stay completely single and pay for a surrogate in the USA ($$$$$), or pay for a surrogate from an overseas country with a significantly lower GDP ($$), or just get a dog ($).
[–]sergio4711 point2 points3 points 6 years ago (2 children) | Copy Link
What is usually bigger in US: alimony or cs? I tried some calculators online but there are too many variables and I guess common experience would tell better.
[–]SexualRex1 point2 points3 points 6 years ago (1 child) | Copy Link
Divorcing couples with two incomes in poverty or low middle class don't really have to worry about alimony except in rare cases. Any other two income households don't either so long as they make very similar amounts. It is mainly for the traditional stay at home housewife; she can divorce her husband and he will have to pay around half of his salary to her in order to subsidize her "standard of living" from when they were married.
It is cases like this that drive a lot of divorced men to suicide. By the time he loses half of all his assets, is forced to pay child support despite usually having "joint custody", loses half of his future retirement or pension, pays his taxes to the state and federal government, and on top of all that has to pay this "standard of living" alimony/subsidy, he is often left with less than 20% of what he makes. Not a very equitable return, so why even work? If he quits or gets fired and falls behind on his payments, he will be jailed by the court, usually resulting in lost employment if he was still employed but unable to pay.
Divorced women are "empowered" both figuratively in the sense that she is a "strong womyn" and literally in the sense that she will still be maintaining most of her standard of living, yet he will be destitute for possibly more than 2 decades, and possibly even after he retires as much as 30-40 years later.
Divorced men are slaves. Disposable slaves.
[–]sergio4712 points3 points4 points 6 years ago (0 children) | Copy Link
So it’s basically dangerous to be a single breadwinner or outperform a wife financially.
And limiting yourself to same income women is not feasible because hypergamy.

what if you make her sign a pre-pre-nup saying she's not being made to sign the pre-nup?
checkmate, thots
[–]ithinkoutloudtoo5 points6 points7 points 6 years ago (0 children) | Copy Link
I think that would be a non-disclosure agreement. You need to also get that.
[–]Solo_and_Simple8 points9 points10 points 6 years ago* (3 children) | Copy Link
They can be tossed out even if she signs it under no duress and this can be demonstrated. Just yesterday, I heard about a case where the woman signed the pre-nup willingly -- she met with her lawyer about it, her lawyer advised her to sign it, and so she did so freely, with informed consent. All of this was documented.
Years into the marriage, she wanted a divorce, and she changed her mind about the pre-nup. She thought it "wasn't fair." The judge agreed with her and tossed it out.

Well, as I'm sure you know, the court system is gynocentric and heavily favors women (at least in the US), so his chances wouldn't be good.

I can't name a single person I'd trust this much. The level of manipulation is quite frankly absurd.
As has been said many times before, when a woman says anything, you can add "Right now I feel like..." to the start of her statement. Trusting any woman to keep her word is exceedingly foolish, especially when regarding future hypotheticals.
That’s why she has ten different versions of the same story. They all benefit her, but it depends on who the story is needed for at that specific moment.
[–]Fantoche_Dreemurr4 points5 points6 points 6 years ago (1 child) | Copy Link
A woman's word is only as good as her current content. It is immediately void if she feels she can get better elsewhere
[–]Mundane_Batrachian0 points1 point2 points 6 years ago (0 children) | Copy Link
It seems men and women have very different ideas about loyalty and obligations.
For men, payment ensures reward. For women, everything is completely mercenary all the time, and some of them just pretend they're loyal because they lack options to cheat.

Prenups is like a faulty condom. You think it will work but no. Put it in a regulated trust. Yes your assets will be somewhat restrictive but no harpy can touch it.

Why even marry in the first place? What's the point? She can't wear white, it's a grossly expensive party to honor her and she'll start thinking divorce the following morning
[–]Solo_and_Simple4 points5 points6 points 6 years ago (0 children) | Copy Link
I wouldn't trust a pre-nup, either. They get thrown out all the time.
[–]SkullPenny3 points4 points5 points 6 years ago (0 children) | Copy Link
Men should flip the question right back at them.
"We don't need to get married or co-habitate... We can do the ceremony, but no need for the legal document. Don't you trust me?"
[–]bos_gee_2 points3 points4 points 6 years ago (1 child) | Copy Link
Whats a prenup?
Pre-nuptial agreement. It's a legal contract entered into prior to marriage. Its purpose is to protect the assets of the person who has the most money and earning potential (usually the husband) from being screwed over in a divorce. If there is a divorce, the pre-nup is supposed to govern how the assets are split up. The problem is that they are often tossed out of court or greatly whittled down.

You said "barring the exception where she has assets she wants to protect," so no. Pre-nups are for protecting assets.

[–]TimJohnsonIII1 point2 points3 points 6 years ago (0 children) | Copy Link
Most people don't understand how prenups work, which is why women always tell men avoidant of marriage, "just get a prenup". A prenup won't read, "You can never take my assets, gold digger. Sign here." Prenups don't prevent you from getting cleaned out. They just limit how much you can get cleaned out in the early years. As others have said, they're vulnerabe to activist judges and false accusations/pretenses, but they become useless after the first few years regardless. If a prenup manages to protect you at all, it only limits the damage for a few years at best. To really protect yourself, you have to setup an irrevocable trust some years before marriage, but an irrevocable trust won't suit the vast majority of men. Setting up a trust post marriage does not work. It has to be setup well before and be a certain type of trust. Trusts are out for the majority of men.
