First let me give a little background. I am Jacobs stepmother. I love him like my own, however I know he isn't. I have a daughter, Jacobs half-sister. I am married to Thomas, Jacobs father. Jacobs mother is Trisha.
The COURT ORDER allows my husband to have his son one weekday a week, if it can be arranged, meaning if she doesn't have plans with him and everyother weekend.
Weekday isn't specified.
However if we get him in the morning, Thomas would give him back that day if she wanted him. He feels he should get him overnight, if we get him in the evening. She doesn't want to allow overnight visits during the week.
On the very first night we had him overnight during the week, the next day he had a "bad day" at daycare. We corrected the problem, he hasn't had a bad day since.
On numerous occassions she has not allowed my husband to have his son, even though it could be arranged. As well as cut my husbands time short with Jacob. Which we have evidence.
An example would be, my husband was unable to spend the entire Fathers Day with his son. He gave Trisha his entire weekend for Mothers Day, which he didn't want to do, however I told him it would be best for Jacob to get that time with him mother. He then agreed.
Due to Thomas wanting Jacob overnight, Trisha is taking him back to court. He doesn't know for what, however it's probably regarding custody and visitation.
She called my husband disrespecting him and telling him he couldn't see his son, so he got snippy back with her. They were arguing on the phone for almost 10 minutes and I saw it was getting no where. Thomas handed me the phone and asked if I could talk to her and tell her he'd call her back. I grabbed the phone and respectfully told her that Thomas would have to call her back, because the arguing was getting no where. She then said that I had no business in this or Jacobs life. That was the very first time I've ever tried to communicate to her, about my husband.
On Fathers Day, my husband told her she could get him at 8. Which, is what plan I was aware of. She messaged me, due to his phone being cut off and got extremely disrespectful towards me for asking 3 questions. I asked, because my husband told me to.
I by no means am saying my husband is 100% right, actually, he can be very hot headed and disrespectful. However, hes only that way with Trisha when she refuses to allow him to see his son.
A little bit on Trisha, she has narcissistic tendancies. She lies about alot of things and purposely changes things to her advantage.
If there's any advice anyone can give us, I'd love to hear it.
She will have a lawyer, Thomas can not afford one. Because it's not a criminal case, Thomas can not get a free one.

She's absolutely right. You need to stay out of it, because it is none of your business froma legal standpoint.
All you're going to do is hurt your husbands chances of getting any further relief from the court, and any decent lawyer will tell you and your husband the same thing, because courts routinely view it as 3rd party interference on your husbands behalf - again, that can hurt him in court - so you need to take a back seat and stay completely out of it as far as she and the courts are concerned. To them, you're nothing but a stranger/bystander that has no legal standing.
So far as the mother and court are concerned, you are nothing to the child.
This can only be rectified through the court with a judges decision and order.
You husband needs to speak with and retain a decent fathers rights attorney. They often will work your the low income clients and arrange payment schedules. Perhaps you and your husband can work more to earn a litttle extra to afford the payments.
