The 1996 federal law against FGM was struck down by the Supreme Court in November 2018.

Sadly it wasn't due to the law's sexism, which only prohibited genital cutting for girls, not boys. Instead, the Court ruled FGM to be a local criminal activity - a matter for individual states to regulate.

At the time, only 27 states had laws banning FGM, surprisingly making the procedure legal again in the other ~23 states.

The method used by the Dawoodi Bohra sect in the USA v Nagarwala case is just a tiny nick on the clitoral hood (with sterilized medical tools), leaving otherwise fully fuctional genitalia.

As other states introduce laws against genital cutting for girls, there will be more opportunities to argue that equal protection either bans or permits it for both sexes. If female cutting is always illegal, with no exceptions for religion, then male cutting is equally prohibited. Alternatively, if religious beliefs do allow an exemption, like for cutting boys in Judaism and Islam, then cutting girls is similarly allowed.

Of course, anyone should be allowed to have the procedure done once they turn 18.
