Why does whatever the attacker was hoping to get out of the exchange matter when it comes to punishment?

Intent matters a lot in crime historically. Idk much about law, but someone running over a guy by accident or in actively trying to kill him are two different categories and it should treated as such.

One perp did it by accident for whatever reason and the reason is important (weather - fog, ice, driving intoxicated, texting, etc) to come to a reasonable punishment whether it's as simple as 1 year probation or taking away the license perpetually. The other perp is a murderer and needs to be locked up for the safety of society.

The problem with rape isn't that the crime is categorized, just how the evidence doesn't need to be there like with other crimes. Each case and woman must be treated like an innocent little angel whether she is found in some back alley with bruise marks or she invited the dude over at 3am and gave him the alcohol. SJW cries over "victim blaming" effectively creates a situation where questioning the accusation becomes a no-go, unlike any other crime, stacking the odds against the accused in an already stacked system.

The problems with "hate crime" legislation is that its often created and enforced politically, and crimes are no longer by individuals against individuals, but creating groups some that are more protected than others. Although it would be nice if prison rape was treated like an actual problem.

Two notes:

First, "hate crimes" are really "thought crimes". They don't really have much to do with the victim, i.e., if you're getting beat up because you're being robbed, or because the other guy just doesn't like you and people like you, it pretty much doesn't matter. Maybe the hater guy beats you up a bit more. Or take murder. Either way, you're still dead.

Hate crimes are about "moral signaling" and how much "integrity" the pols who passed them, their supporters, and by extension the group they supposedly protect have. Remember, all of the "good laws" have been taken already - i.e. murder, rape, armed robbery - and "progressives" in order to show how "good" they are, need to keep passing new laws so they can say, "Look how good we are! Look at what we're doing for you!", etc.

Second, if you're reading a liberal newspaper, in my case the New York Times, and there's a crime story, and they don't mention the race of the perp? It's a black guy. They'll show a photo of him, because evidently that's not "RACIST!!!" but they won't describe him as black, etc. Because that would be "wrong", somehow. /shrugs

You're suggesting a classiest system of "who has the best lawyer". Considering the state has billions to hire the best attorneys with our stolen money, that would be very, very bad.

In Canada there are two types of "hate crimes". One is in advocating for genocide and similar such things. The other is hidden in the sentencing provisions and refers to where the victim was targeted due to their race or gender or whatever.

Additionally, there is no such thing as "rape" there is only sexual assault, although then there are separate sections for sexual assault causing bodily harm and aggravated sexual assault.

Assault and battery still remain separated in the civil law but they have all but merged in the criminal law.

It baffles me why we need terrorism laws, bikie laws (im in Aus) etc. any thing a "terrorist" or "bikie" can do we already have a law for, ie murder, arson, theft.

It comes down to the importance of context in assessing blame.

I shot him
I shot him in fear for my life
I shot him in fear for my life since he was running at me brandishing a knife.
I shot him in fear for my life since he was running at me brandishing a knife, on my property, is about 80lb of muscle larger than I, and has a demonstrable history of violence against my demographic.

Context and intent are important, if you can make a reasonable case for them. In fact I'd say context is the reason men don't get a fair shake publically when it comes to m v f cases. For example, context can cause a dismissal of many rape claims, and can also aid in correct convictions.

If you get hit and you're a straight white male, that's slightly bad. If you get hit and you're non-white or female or gay it's a hate crime and is worthy of more punishment.

While I can agree that laws should ensure gender neutrality before the court, I disagree with the premise of removing identifiers. While a degree of assault can range from unwanted touching to intentionally causing physical harm to another. The next level would be aggravated assault, which would usually be defines as assault with a weapon. Simple assault is usually a misdemeanor, while aggravated assault is a felony.

Sexual Assault is more similar to aggravated assault as it can cause extended harm to a victim and therefore deserves to be treated more seriously than a simple assault. It involves the demonstrated intent to coerce someone against their will.

I don't mean to say that sex crimes aren't bad, or that there aren't a unique set of symbols and words used to threaten certain minority groups. Hate crimes are retarded, you dont murder your loved ones. The rest are fine though some revision is highly necessary.

Think about it. An assault is the threat of touching someone in a way they don't want to be touched. A battery is the touch in question. Why does whatever the attacker was hoping to get out of the exchange matter when it comes to punishment?

I assault you because i got mad at a comment you made. I assault your girlfriend because i wanted to rape her. Why would this matter when it comes to punishment?

I wonder what would happen if sexual assault was reclassified as a degree of assault, rapes were reclassified as a degree of battery, and hate crimes were reclassified as yet another degree of assault? I realize that the names of the crimes don't matter, but don't they?

Because that would complicate everything and inflate certain offices. If you split sexual assault and physical assault, you get two lines for the same crime plus you have a better catalog by intent (harm or a sexual intent). Its more efficient.
