I read a lot about alimony in here. To be forced into servitude is illegal, unconscionable, and unjust. But until things change, we men are going to be discriminated against in family court on a fairly consistent basis. I know I was. So I thought I would write up a quick primer on how I got out of paying alimony, made the judge almost have a stroke, and forced my ex to get a fucking job and support herself. Let me say up front ... PAY YOUR FUCKING CHILD SUPPORT! They are your kids ... it's your responsibility to provide for them ... NO MATTER WHAT.

Preface : Divorced 6 years ago with a 10 year stipulated judgement (19 year marriage). Original alimony order was $3500 a month. This is because at the time I made a lot of money. In addition was $1500 a month in child support. I paid, no shortages, faithfully for 4 years. Never missed even once.

HOW I got out of alimony : When my job changed I was unable to continue to pay the egregious support. I filed for modification, was denied. I filed again. Was denied again. I appealed ... denied. I was living off $1700 every 2 weeks while my ex was getting $2500 every two weeks - garnished from my paycheck. I knew I had to do something. So I came up with a plan ... First, I had to get away from the garnishment. That meant changing jobs. But what if I changed jobs and they came after me and garnished my wages again? That meant changing jobs to a MUCH lower paying job so I could get a REAL modification on the support. I was barely making ends meet how it was. AND I had recently been remarried. HOW could I MAKE LESS, get a REAL support modification (elimination), and MAKE MORE all at the same time? Pay attention grasshopper .. I'll show you the way.

First, I found a new job consulting making twice as much as I had been making. That was good. And no garnishment ... YET. After a few paychecks came in, my new wife went to legalzoom.com and started a new S-Corp. When the paperwork was done I told the consulting company I was working for that i wanted to switch from W2 (paid hourly) to whats called a C2C ... or Corp to Corp. Under C2C they no longer pay me, they pay the corporation I was working for (my wifes corp). Then my wife set up an ADP payroll account, and began "paying" me a very low salary. At the same time I was applying for jobs I knew I couldn't get online to create a "paper trail" that I was trying for a better job. THEN I filed for ANOTHER modification. This time ... things went much differently. I told the judge "I do not want to change child support .. it is my obligation, honor, and duty to support my children". The judge REALLY liked that. But on the FL-150 he could CLEARLY see I was not making enough to continue to pay the spousal support. My ex wifes attorney claimed I was intentionally working "below" my means. Then out came the paper trail of all the jobs I had applied for (that I already KNEW I would never get). And of course ... my paycheck stubs from my wifes corp. Alimony was dismissed. My ex was forced to get a real job. I make more now than ever. And my new wife is very happy.

So that's how I beat the incredibly one-sided, biased, unjust system.
