Shoot for joint custody/shared parenting, the judge should be obliged to at the very least maintain the status quo as long as it can be reasonably managed with his pre-school.

if I do get joint custody/ share parenting would I still have to pay child support? I'm a great father, my son loves me and prefers he stays with me more. He's always sad when he has to go back to her house. Do the Judges bring kids into the family court?

I'm in the same situation right now, except instead of seeing my kids for 2 weeks per year (after being a stay at home dad for a year), she wants it to be nothing at all. Good luck!

I can't really help you with getting more time with your son, but I have some advice from my experiences with my father. My parents divorced when I was 5. My dad had visitation every Saturday with me. From the time I was 5 until I went away from college, he only missed 3 Saturdays, two because of illness and one from car breakdown. He made Saturdays all about us. We spent the days doing activities I liked and teaching me all sorts of things he thought would be useful to me. He talked during the 45 minute drive between homes about being a man and all the lessons he learned in his life. We may not have had as much time together as we would have liked, but we made the time count.

I don't agree with the advice to get a lawyer. Try to persuade your ex.

An insufficiently fathered child is more likely to be a criminal/alcoholic/depressive/suicide victim than one who has good access to both parents. Cooperation is the best policy, not the conflict the legal profession feeds on. Try to see things from her point of view and be willing to cooperate on whatever she might fear; problems with you, competing for the child's affection etc.
