This ruling is a ridiculous consequence of ridiculous premises, ie:-

"That a Womans body is her own and she can do what she wants with it"

and

"The best interests of the child prevail"

They have no real basis other than to give legal credence to abortion; the idea that a fetus is not a person and to give a workable legal principle that won't offend powerful groups.

They are a legal/political fashion statements. They are not moral imperatives cast in stone.

Our bodily integrity is not assured in many other circumstances eg. imprisonment, execution, circumcision, cavity searches, the draft, DNA sampling of the arrested and endless serious public health related issues. Similarly the best interests of the child are no where to be seen when a father is sent to jail for a crime. Having a good father stay to support and nurture his family is clearly in the best interest of the child.

I think this is a valid question, though the legal and ethical answers probably aren't going to be the same due to the standards on which abortion laws are based.

IMO, removing a child from the proximity of the other parent is the same whether the baby is still in the womb or has experienced birth, especially if the mother has chosen life over abortion.

If it's followed by or done to achieve the condition of deliberately blocking the other parent from contact and interaction with the child, then yes. It's kidnapping, the same as it would be kidnapping to do that with a 6-year-old in the middle of a divorce-and-custody battle.

If it's something that occurs as part of the mother's life circumstances, and she cooperates with the father's effort to maintain a relationship with their child, then it's no different than any other circumstance of breakup related family estrangement.

All of that said, I also think that at the moment of birth, initial consideration of the two parents' rights and responsibilities related to the child should be equal. Custody should not be an automatic thing for the mother. If it is in dispute, both sides should have equal burden and equal chance to prove which home would most benefit the baby.

I strongly suspect that under that legal environment, fewer mothers would ignore the repercussions such a separation might have on their children and their children's fathers when considering a move.
