I don't see a problem with this. In my opinion this would be the same as agreeing with the legality of the woman who got child support from the guy she gave a blow job to, and then used his semen to inseminate herself. Both instances should have been denied.

To clarify, once the semen is extracted from the body, it is in my opinion that person(s) involved in consented use of the semen are solely responsible. Whether that be a couple trying to conceive by artificial insemination or a lonely woman with a turkey baster, even if that woman is the widow. The man, the man's estate, and/or inheritance isn't responsible.

How would we feel if they had separated, divorced or if she killed him and woman'ed her way out of it, then did this to get her hands on his estate? We wouldn't agree with it then, and we shouldn't agree with it now.

there is no one to challenge paternity or question whether or not he did want her... maybe the wife just grabs benefits for some kid she has with someone else after the father died

i also didnt know social security was offered to 8 year olds?

States are broke, so it's not surprising they're going to fight tooth and nail to not pay benefits if there's a chance they don't have to.

Sucks for the kid, but I have to blame the mother for having a kid she couldn't afford to raise on her own. If she can afford to raise the child then why is the father's benefits such a big deal? Why keep pushing the issue trying to get a handout from the state?
