U know the cool thing about this is ,the girl firstly has not done anything illegal , and the reason they did not say he was raped , because according to the Indian constitution men can't be raped , Secondly if she wants she can file a rape case on her brother and he will be impriosened untill he is proved innocent (which takes almost 10 years in India ).
