Wait.. so not only are the UK trying to make it so that a woman accusing a man of rape can pre-record her testimony (and can likely re-record it if she doesn't feel she got it right) but now Police are not going to be allowed to search her phone for evidence that could prove things either way..

In other words.. in the UK if a woman accuses you of rape, not only are you now apparently guilty until proven innocent but now they are hamstringing defendants to make it even harder to prove they are innocent.

What an absolute shit show!

Interesting that the article doesn't say that in Liam's case the womans 40,000 messages proved his innocence. It reads like the case just collapsed due to the disclosure issues.

Those messages actually proved that she had pestered him for sex, not the other way around as she claimed. They showed that she had told him that she wanted violent sex and even spoke about wanting to be raped. They even showed that she had made it clear to a friend that no crime had been committed.

All that was why the case was dismissed. If they ban the police looking at an accusers phone they will ban the police from finding the truth!

The Daily Telegraph recently reported that Priti Patel, the Home Secretary, and Dominic Raab, the Justice Secretary, put forward amendments to the proposed legislation in an attempt to stop so called ‘digital strip searches’ blamed for plummeting conviction rates

Suggesting the only reason that there's plummeting conviction rates is because searching a victims phone can result in men being convicted less because evidence on the phone shows she's not been truthful, which has happened many times when revealed in messages to/among friends, which I can only conclude means that they WANT to convict men who are innocent... Fuck that's terrifying.

The amendments would make it illegal for police to place a victim under ‘undue pressure’ to agree to their phone being searched, that a victim must be told what information is being sought and what line of ‘reasonable’ inquiry officers are pursuing. ‘It follows claims that rape victims have been forced into “digital strip searches”, where they have been told refusal to hand over their phones to police will end inquiries,’ the Telegraph reported.

If the potential victim is making false accusations then telling her what they're going to search for gives her time cover any tracks and delete potential evidence. The pressure certainly isn't 'undue' and calling them "Digital strip searches" is a pretty transparent attempt to trigger you to link searching someone's phone/message history with the more invasive and physical process of being stripped down naked -which in the context of rape victims would add to existing trauma-. Using language like that to intentionally conflate and manipulate... All they're doing is searching your phone which can also be used to prove a victims story to be truthful, if you're telling the truth then you've got nothing to hide and should infact want them to search your phone as it could help get a conviction.

Instead of eliminating due process directly, they are quietly eliminating ways an accused can use to defend himself. As rape is gendered in UK, so they are only denying due process for men.
