There is more to this case than the article let's on. The girl had consensual sex with the boy multiple times in the school bathroom. The boy text her and asked to meet in the bathroom again, and she did, and they had sex again. She then told police she was raped and lied about having sex with him in the past.

During opening statements of the two-hour hearing in Loudoun County Juvenile and Domestic Relations District Court, prosecutor Barry Zweig said the two teens chatted daily on the Discord app, in the weeks leading up to the May 28, 2021, incident at Stone Bridge High School, in Ashburn. The teens had “sexually charged conversations,” and had engaged in consensual sexual relations twice in weeks prior, in a bathroom at the school.

On May 28, the boy texted the girl and asked her to meet him in the girls bathroom, and she agreed. However, during that encounter, he forced himself on her, without her consent. The young victim described her relationship with the boy as “just friends,” but said she “hooked up” with him, twice in the two weeks before the assault.

During cross-examination by defense attorney William Mann, the girl acknowledged she hadn’t told investigators initially about the consensual encounters.

No one knows if the sex was consensual except them so the fact that she deliberately lied about the nature of their relationship is a major red flag. Also, they had met for sex in the bathroom twice in the recent past. He messaged her asking her to meet him in the bathroom again. She agreed. If it wasn't for sex then why would she agree to meet him in the bathroom? To help with homework? Obviously not.

Except the Judge heard that testimony and saw all the evidence and still found them guilty. We weren't in the courtroom, we didn't get to hear from the now convicted rapist. The "hole" just speaks to the credibility of the victim, but it doesn't exonerate the rapist. This is like "Intro to Criminal Law", but I'm a lawyer IRL, so maybe it's just because I understand how the system works.

Yes, it can.

It's a he-said-she-said case. No one knows if the sex was consensual except them so the fact that she deliberately lied about the nature of their relationship is a major red flag.

And that's why the Judge in this case makes findings of fact and decided he was guilty. That's why you go to Court, to weigh evidence for and against the charges brought. The Judge here heard all the testimony and still found the person guilty.

This is mostly irrelevant to whether he raped her on this occasion. What you're offering is circumstantial evidence, but nothing more.

Do you think it's a coincidence that this individual was also charged with sexual assault of a separate child in a separate school after this incident? Usually false accusations against non-famous people have only one allegation.

The justice system can't operate in a spectrum. You are either guilty or not guilty. The word reasonable doesn't mean that you have to consider every possible scenario under the sun. Her allegations are also not considered hearsay under the legal definition of the term because she is reporting a crime that happened to her. The facts about their previous encounters do increase the buden of proof but not by themselves. A judge or jury will look at all the evidence as a whole and not as singular pieces that prove or disprove anything.

Nobody is getting denied anything. Trans people have been using bathrooms all their life. Look harrasment in bathrooms is wrong but if you are so afraid of harrasment you should use the other bathroom. I mean the bar is so low now that even staring can be considered harrasment by some people. The sensible solution to all of this is of course eliminating "the gap" and just making single person stalls or family stalls. No more long wait lines for one gender while the other bathroom is unused.

Except that this was not a trans student. This was a cis student that put on a skirt and pretended to be trans so that he could go into the girls bathroom and rape a female student.

These bathroom policies make it easier to do this sort of thing.

We all know that assaults can and do happen. The concern is that these predators will take advantage of the mixed bathroom policies, and that is exactly what happened here. Back in the day predators knew that they would get called out if they were seen in the girls room. Now they know that nobody will say anything.

Also yes VIOLENT VICTIMIZATION is The suicide and self harm talked about in the article. And no, sorry. Here in the real world personal responsibility is a real thing. You don’t get to take a group of people who are de facto prone to much higher self harm rates then the average and chalk that up to society.

It’s more of a condemnation of the trans movement for disingenuously trying to “help” their cause by blaming their problems in society when people who self harm really just need help themselves. They need therapy and support to get over their personal issues. That’s why I’m working on becoming a psychologist so I can help people understand the proper way to help themselves solve their problems and lead happier lives instead of getting caught up in becoming victims of society, to which there is no solution. :)
