Regardless of the fact that the man is 17, it does not sound like the encounter was at all consensual, according to how I read the article. I am confused, was he forced to take this substance or did he willingly take it? Now, if the law says that being 17 is underage then, it is a breaking of the law but, was it consensual or not?

The Florida Uniform Crime Reports program defines Rape as the penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person or object, without the consent of the victim.

So yeah it legally is not rape.
