That is, if any is left after the attorney fees. Sounds like you'll be paying for her lawyer, too. So, don't argue over petty things like furniture, appliances,etc. It's easy to rack up $2000 in attorney fees arguing over a $500 washing machine.

Most states are no fault divorce and community property. Confirm for your state. That means ALL assets and debts acquired during the marriage are to be split 50/50. She as a credit card she never told you about with $50k on it, that's half yours. Your 401k at work, that's half hers. You do not need to split everything in half though. Her medical debt is therefore 50% yours too most likely.

Eg $100,000 cash and $60k 401k. So $160k total and $80k each. BUT you can ask to keep your 401k + $20l cash, and she gets $80k in cash. That's 50/50.

As for spousal support / alimony, varies from state to state. Look up the rules for your state, but if there a large difference in your income might be on the table (normally for a few years, but not life).

IF you guys have no major assets, simple debts, nearly equal income and no kids. You might want to just try mediation OR DIY. If she's reasonable can write everything up, have each of your lawyers review, submit, sign and done.

Without kids, it's simple. Add up all marital assets and liabilities, then divide by two. You each get half. So unless that $100k in cash was premarital (unlikely given the length of your marriage), half is hers. But that will be offset by her medical bills.

Last time I checked, spousal support in Indiana is rehabilitative -- lasting only 3 years.

Can she prove you had $100k cash? If not then it doesn’t exist. Just my opinion though but I wouldn’t disclose it to anyone if she didn’t know about it or has no way to prove it.
