Well, a big problem I'd reckon with the court system is bias. Looking at andrew tate as a recent and high profile example, it recently came to light he had damaging audio tapes regarding SA. Some trendy comments have been "oh thank God, it came from Vice so it must be fake" which is alarming IMHO because the biggest hurdle facing most accusers is evidence. Having it and still being dismissed, I honestly don't have many words about that, but it just doesn't make sense.

And to your point about public opinion, I get it. I've personally met people whose reputations were ruined by false accusations. That is an obvious bias issue we need to tackle. Then on the other end of the spectrum we have communities like this sub and its obvious slant towards rape being unlikely/generally a lie. Some people champion it as just balancing against the other bias but imagine your jurors champion one way or the other. Thats a problem.

So I guess my point is that you dont *need* an alternative to point out our system sucks, we just need to be willing to confront our biases and improve the system we already have.

I guess I don’t see how to confront the bias because of people’s zealotry and the inability for people to admit that they were wrong.

In the Tate example, there is evidence that he said some questionable things; but it’s there evidence that he did something? I haven’t seen it. I’ve heard people summarize it, but I haven’t seen it so I’m unclear if he did it or if there is a bias from the provider of the information (ie fake news if it were).

In the feminist subs, I see bias one way because I see them state suspicion as evidence. I see other sub as providing an alternative view stating lack of facts as evidence. Given that I don’t have an alternative, I assume the court of law (who get more facts than me) to provide a verdict.

All that said, this is just conjecture between you and I and I feel that we are unable to have the outcome go into a fair and balance view because I believe that doing that would go against their world view and their perception of their beliefs.

Given that we don’t know the answer, I use court cases to define the answer. I believe that those with implicit bias will tell me the answer is completely wrong and it’s much higher (like 90%), but then cannot define a method to come to that answer other than “it feels right”. Similarly, there are those that it’s 0%. It’s also wrong.

I’m seeing it as boolean. I agree that the current methods are not 100%, but I don’t have any better info. Due to this, I use the ones that we have and hope to improve them. At present, the current number is 10% (or whatever it actually is) so I say the number is 10% and I hope that people are working to improve the the answer.

I disagree that we should allow gray areas to continue to be gray (the number convicted in X, but I have no idea what the other number is).

I feel that we should have it black and white and continually iterate to improve the process.

I’m sensing that we’re saying virtually the same thing with slight points of difference here and there, but that they aren’t far off. I’m sensing that forum posts and text is not the best way to describe the slight differences in our opinions. That said, I do appreciate the polite discourse (a rarity sometimes). :D.
