In your first case, the woman is still responsible for birthing a child that she doesn't want. That won't fly with the vast majority of people.

Feminists will bitterly oppose your idea. The only acceptable changes in their view are ones which increase the number of rights women have and reduce the number of responsibilities they must carry. Your suggestion does neither.

I think we should balance women's bodily autonomy (which I support. You shouldn't be able to force a woman to carry or birth a child) with giving men the legal right to preemptively abdicate parental rights and responsibilities. This gives both parties the opportunity to opt out of Parenthood without ever forcing anyone to opt in against their will. It seems like the optimal solution.

If you believe in equality, as feminists claim to, there are two options.

OPTION A: If a woman has the right to unilaterally choose to have have or abort a child, THEN the man should have to the right to paternal surrender. Paternal Surrender allows a man the right to relinquish his paternal responsibilities if he consented to sex but did not consent to fatherhood. The woman may then choose to either have the child and care/pay for it herself or to have an abortion. Her body, her choice, her responsibility.

OPTION B: If a man does NOT have the right to relinquish his paternal responsibilities when a woman becomes pregnant THEN in the case when a woman wants to abort the child but the man does not, abortion should not be legal. The woman should be required to bring the child to term. She would then give the child to the man to raise and, of course, she would be responsible for 1/2 the cost of child support for 18 years.

If you believe in equality then choose one.

With pregnancy, while women hold all the cards regarding both sexual activity AND as responsible for their own bodies, they instead choose to have sex that gets them pregnant. And then the guy is blamed.
